It is undisputed that both marks use an equal symbol flanked by less-than and greater-than symbols. ( See pages 8-10 above.) New Balance, however, argues that any similarity between the marks is unlikely to cause confusion because both New Balance and Denimafia use the symbols in conjunction with their respective house marks. The Court agrees.New Balance also argues that the marks are dissimilar because New Balance's mark "uses straight lines, solid printing, and a more elongated representation," whereas Denimafia's mark uses "distinct printing that makes the symbols appear to be a stamp" and is further distinguishable by "the curves of the arms in the greater and less than symbols." (Defs. Br. at 13; Defs. Reply Br. at 3; see pages 8-10 above.) The Court does not agree.

The Court finds that no reasonable juror could find that Denimafia's evidence demonstrates any actual confusion and, thus, no reasonable juror could find that Denimafia's evidence outweighs New Balance's expert survey results.Denimafia argues that questions of fact exist as to New Balance's intent in adopting the mark because New Balance knew of Denimafia's mark and chose to use it despite options of "variations more different from the 5EP LOGO." (Dkt. No. 103: Denimafia Opp. Br. at 16.)
Après un rapide passage par le vestiaire et la consigne, je me retrouve rapidement delesté de mes affaires, prête à courir. Pour cette fois encore, j'avais choisi mes chaussures de trail New Balance pour courir, un corsaire de trail, un basique tee-shirt adidas superstar cheap de running et mon sac de trail le tout Kalenji. Ma fidèle montre Vivoactive Garmin était cette fois encore à mon poignet.Merci à l'équipe pour le dossard (Fabien, Amandine, si vous me lisez & ) et merci à New Balance pour l'équipement. J'ai définitivement adopté les et elles m'accompagneront encore sur le prochain, les 22 km du Trail des 2 Buttes le 10 avril prochain, j'ai adoré les poches du corsaire qui m'ont permis d'y mettre gel et barre aux amandes pour les avoir à portée de main sans être encombrée pour autant. A l'année prochaine pour le 30 km ! | |
